I Wouldn't Be Surprised!

This wouldn't be surprising in this day of radical activist judges.

Fed Judge Blocks Parts of California Gun Law

A federal judge blocked key provisions of a California gun law, ruling them as violating the Second Amendment.

The Associated Press reported:

LOS ANGELES (AP) — A federal judge on Monday blocked key provisions of a California law that drastically restricts the sale of new handguns in the state, saying parts of the legislation violate the Second Amendment.

A lawsuit challenging the law was filed last year by the California Rifle & Pistol Association and other gun rights supporters following a landmark 2022 decision from the U.S. Supreme Court that set new standards for evaluating firearm restrictions. The ruling left many laws aimed at regulating and limiting the sale and use of guns — in California and nationwide — at risk of being struck down.

U.S. District Court Judge Cormac Carney, sitting in Santa Ana, wrote Monday that California’s requirements for new handguns are unconstitutional and cannot be enforced. Because of these restrictions, Carney wrote, no new models of semiautomatic handguns have been approved for sale since 2013 and Californians are forced to buy older and potentially less safe models.

I am wondering when a lawsuit will be filed against New Mexico's H.B. 9 law that was just signed by Gov. Lujan Grisham.

Ban On Guns With Serial Numbers Removed Is Unconstitutional

This is sure to give liberals apoplexy!

A federal judge has ruled that bans on guns with serial numbers removed are unconstitutional.

According U.S. News & World Report:

(Reuters) -A federal judge in West Virginia has ruled that a federal ban on possessing a gun with its serial number removed is unconstitutional, the first such ruling since the U.S. Supreme Court dramatically expanded gun rights in June.

U.S. District Judge Joseph Goodwin in Charleston on Wednesday found that the law was not consistent with the United States' "historical tradition of firearm regulation," the new standard laid out by the Supreme Court in its landmark ruling.

The decision came in a criminal case charging a man, Randy Price, with illegally possessing a gun with the serial number removed that was found in his car. The judge dismissed that charge, though Price is still charged with illegally possessing the gun after being convicted of previous felonies.

No doubt this decision will be appealed.

NRA Loses Challenge On Gun Store Closures

The following is not surprising, considering that many, if not most, of the judges in California are liberals.

This ruling may be overturned if it goes to the 9th Circuit Court since it is now more conservative thanks to recent appointments by President Trump.

But, as the article states, the issue is moot since the L.A. County Sheriff has allowed gun stores to reopen.

From The Daily World:
LOS ANGELES — The National Rifle Association failed to convince a federal judge that the temporary closures of California gun shops prompted by the spread of the coronavirus was unconstitutional.
U.S. District Judge Andre Birotte in Los Angeles on Monday denied the NRA’s request for a temporary restraining order to prevent L.A. County from treating gun stores as non-essential businesses during the pandemic.
The judge said the city and county of Los Angeles didn’t overstep their authority given the significance of their aim to reduce the spread of the coronavirus and the appropriateness of store closures to achieve that aim.

Texas Federal Judge Rules ObamaCare Is "Unconstitutional"

A federal judge in Texas (a highly respected one) ruled that ObamaCare is "unconstitutional".

According to the Denver Post:
WASHINGTON — A conservative federal judge in Texas on Friday ruled the Affordable Care Act “invalid” on the eve of the sign-up deadline for next year. But with appeals certain, even the Trump White House said the law will remain in place for now.
In a 55-page opinion, U.S. District Judge Reed O’Connor ruled that last year’s tax cut bill knocked the constitutional foundation from under “Obamacare” by eliminating a penalty for not having coverage. The rest of the law cannot be separated from that provision and is therefore invalid, he wrote.
Supporters of the law immediately said they would appeal. “Today’s misguided ruling will not deter us: our coalition will continue to fight in court for the health and wellbeing of all Americans,” said California Attorney General Xavier Becerra, who is leading a coalition of states defending the ACA.

Yes, an appeal is expected.
