New Mexico Civil Guard Activities Restricted By Judge

New Mexico Civil Guard. Now that's a name I haven't heard for a while (about a couple of years or so).

A District Judge, Elaine Lujan (What, another Lujan?! They seem to come out of the woodwork like cockroaches.) ruled against the New Mexico Civil Guard over activities during protests of of BLM and others of two years ago when they were out vandalizing statues and other private and public property.

According to the Associated Press:

ALBUQUERQUE, N.M. (AP) — The New Mexico Civil Guard has been barred from publicly acting as a military unit without authorization or assuming the role of law enforcement by using organized force at public protests or gathering, according to a newspaper.

The Albuquerque Journal reported Tuesday that District Court Judge Elaine Lujan also has banned such activity by the group’s directors, officers, agents, employees, members and any of their successor organizations and members.

Lujan granting a motion by Bernalillo County District Attorney Raúl Torrez, who told the Journal that the decision, “fundamentally represents a victory for the rule of law….We’re trying to prevent violent extremism.”

There may be some constitutional protections that support the Guard that can be used as a basis in filing an appeal over Judge Lujan's ruling. After all, the police did nothing to protect property, so somebody had to step in.

New Mexico Civil Guard Suing and Being Sued

It has been a while since I last saw any news about the New Mexico Civil Guard militia group.

Well, it turns out that some members are suing the city of Albuquerque for being arrested and detained by the police at an Old Town protest even though they committed no crime.

And, the Bernalillo County District Attorney is suing the New Mexico Civil Guard.

KRQE reported:

ALBUQUERQUE, N.M. (KRQE) – A militia group that showed up to the Juan de Oñate protest in Albuquerque last year with guns in hand is suing the city. They claim they were targeted that night by law enforcement. The New Mexico Civil Guard claims that they didn’t do anything wrong that night and believes the city zeroed in on them anyway.

About eight members of the heavily armed militia, the New Mexico Civil Guard showed up to last summer’s protest of the Juan de Oñate statue near Old Town. Now, several of them are suing the city. According to a federal lawsuit, the guard says city officials targeted them for no reason. They allege that the city was aware the Civil Guard was going to be there that night and positioned officers near the protest waiting until a Civil Guard member “committed a crime and planned to then arrest them.”

On the District Attorney's lawsuit, KRQE reported:

ALBUQUERQUE, N.M. (KRQE) – The lawsuit is moving forward against a local militia group for its role in a violent protest last summer. The Bernalillo County district attorney brought the suit against the New Mexico Civil Guard. Its members showed up armed to a protest against the Juan de Onate statue in Old Town saying they were there to protect the statue from the crowd.

The district attorney’s office calls the Civil Guard a right-wing extremist group and accuses its members of acting as vigilantes. “It’s just not right for any group to think they have the power to take the role of the police, take the role of the militia, or go out and threaten other citizens,” said Bernalillo County District Attorney Raul Torrez.

Bernalillo County D.A. Files Lawsuit Against New Mexico Civil Guard

It looks like Bernalillo County District Attorney Raul Torrez wants to be New Mexico's answer to California Attorney General Xavier Becerra, a noted radical leftist imbecile.

Torrez has filed a lawsuit against the New Mexico Civil Guard.

KOB 4 News reported:

ALBUQUERQUE, N.M.- The Bernalillo County district attorney filed a lawsuit Monday against the New Mexico Civil Guard, a group that has showed up at protests in military-like uniforms, carrying guns, and telling people they are there to protect property. 

"When you have self-appointed police officers and military units out there advancing their own form of justice, there is no democratic accountability," District Attorney Raul Torrez said.  

The lawsuit asks a judge to order the New Mexico Civil Guard to stop representing itself as a police force. 

"What is affected is their ability to organize, train and operate as an unlawful group," Torrez said.  

The lawsuit also claims the group's "presence fostered and encouraged violence by counter-protestors." It specifically mentions Steven Baca, who is accused of shooting someone at a protest of a Juan de Oñate statue, and is not affiliated with the group. 

New Mexico Civil Guard leader Bryce Provance said in a KOB 4 phone interview that city leaders are trying to divert the blame away from law enforcement over how the protest was handled that night. 

"They are deflecting," he said. "The mayor and deputy chief ordered their officers not be in an area so that violence could be carried out against property against counter protestors and it backfired. Somebody got shot, and then we had to disarm the shooter, form a perimeter around him and hold him until police arrived and because of the mayor and deputy chief's ineptitude, they are going to deflect and try and charge us and sue us whatever they are going to do."

I don't see how the New Mexico Civil Guard represents themselves as a "police force". Torrez's frivolous lawsuit will likely fall flat on its face.

I found the photo to be interesting and humorous.

Governor and Mayor Condemn New Mexico Civil Guard

So the governor of New Mexico and the mayor of Albuquerque want the New Mexico Civil Guard militia to "stay away" from protests and their presence makes protesters "nervous".

Well, it the governor, mayor and the police did their jobs right, the need to have the militia there to prevent rioting, bodily injury and property damage wouldn't be necessary. Tough shit, governor and mayor!

It is good that protesters are made "nervous", maybe then they will think twice before starting destructive trouble.

According to KRQE:

ALBUQUERQUE, N.M. (KRQE) – During Monday night’s protest, a group of heavily armed militia, who call themselves the New Mexico Civil Guard showed up. Protesters said their presence raises tensions and provokes violence and the mayor of Albuquerque and the governor want the group to stay away from protests. The New Mexico Civil Guard said they are armed to deter violence and protect counter-protesters but their presence makes protesters nervous. 

At Monday night’s prayer and protest against the Juan de Oñate statue, were about eight members of a heavily armed militia. “Why do you feel the need to be here?” asked a protester. 

“Second amendment,” replied a member of the Civil Guard. The Civil Guard is a group of people who said they are not affiliated with law enforcement or a political party but they’ve been present at a handful of recent protests in New Mexico which has caused unease among protesters.

Man Shot Over Statue Vandalism In Albuquerque

The following story from Fox News was inevitable. 

A man was shot Monday after gunfire erupted at a demonstration in New Mexico, where protesters attempted to topple a bronze conquistador's statue outside an Albuquerque museum, authorities said.

The man was taken to a local hospital where he was listed in critical but stable condition, police said. 

“The shooting tonight was a tragic, outrageous and unacceptable act of violence and it has no place in our city,” Albuquerque Mayor Tim Keller said in a statement. 

The shooting occurred during a clash between protesters and the New Mexico Civil Guard, a heavily armed civilian group that attempted to protect the controversial sculpture — a monument that features Spanish conquistador Juan de Oñate, according to the Albuquerque Journal. 

Protesters reportedly wrapped a chain around the statue and started tugging on it amid chants of “Tear it down.” At least one person swung a pickaxe at the statue of New Mexico’s 16th-century colonial governor. 

Gunshots could be heard down the street just moments later, with several people yelling, "Somebody got shot," according to the Journal. About five shots were fired by a single gunman after protesters started advancing on him, the paper reported. 

Police used chemical irritants and flashbangs to protect officers and detain those involved in the shooting, Albuquerque police spokesman Gilbert Gallegos said. Officers were seen taking five or six men dressed in military fatigues into custody.

What the hell did Gov. Michelle Lujan Grisham and Albuquerque Mayor Tim Keller expect when they (and others around the country) allow "protesters" run wild vandalizing public and private property for weeks? People are getting fed up over the anarchy that has been going on in the streets of major cities.

These leftist mobs have been using tactics of ISIS and communists in vandalizing and tearing down statues and monuments to destroy this country's history. Many people have had enough. So it comes at no surprise that somebody got shot. I am not condoning it, but I saw this coming.

The only way to stop violent acts is for government officials, at all levels, to impose law & order. Liberals who control these cities have been sitting on their hands, some even encouraging these acts by "protesters".

Don't let Governor Grisham lie to you about the shooting in Albuquerque tonight.. The NMCG were not even near the shooting when it started, but it appears the man in blue was attacked multiple times, By "Peaceful Protesters," starting at 4 seconds in the video and then pulled a pistol to defend himself at 42 seconds..

It looks like a strong case of self-defense to me.

Militia Forming: New Mexico Civil Guard

NEW MEXICO

Volunteers of the unorganized Militia of New Mexico, as defined in NM statute 20-2-2 “All able bodied citizens of the state... who are not less than 18 or are more than 45 years of age...” have been called to a muster at Chelwood park off of Fruit Ave NE by the Lomas Tramway public library in Albuquerque NM on March 14th 2020.

The purpose of this muster is to summon, organize, and train the Militia of NM. The role of the Militia is to defend the Constitution of the United States, the laws, the property of and the citizens of NM and the United States of America and above all to serve our neighbors in any time of need. The Militia will protect, defend and serve the people whether that be from invasion, natural disaster, insurrection, inclement weather, or whatever events may arise that will require the Militia of NM to intervene.

Those who attend the muster must adhere to the following instructions:

• Volunteers will need to provide their name and contact info for further musters. The roster of volunteers will never be given to any town, municipality, county, state or federal agency.
• Volunteers must be able to possess a firearm.
• Volunteers should possess a working rifle, carbine, or shotgun, though rifles are preferred as they are more suited to Militia purposes.
• Volunteers are encouraged to own a sidearm as well.
• Volunteers must be 18 years of age or older.
• Volunteers who do not possess a firearm or are over the age of 45 are heartily encouraged to attend.

Anyone attending the muster as a volunteer or in a support capacity will not wear any clothing or carry any signs containing political messages, and shall only carry, wear, or display the flag of the United States or New Mexico.

We encourage the citizens from across the state to attend this historic muster. We will form eleven companies that will constitute the New Mexico Civil Guard. The companies will be formed in the following NM counties: Dona Ana, Mckinley, Bernalillo, Santa Fe, Lea, Guadalupe, Taos, San Juan, Chaves, Eddy, and another company for all those counties not mentioned. All members will be mustered into the Company of the county of their current residence.

Registration will be from 1200 to 1300 hours [noon to 1:00 PM] regardless of weather. After registration is complete, there will be an address from the organizer of the muster. This Muster will be part of an historic event and will demonstrate the will and the resolve of the people of New Mexico to defend their state and the constitution, protect others, and serve their neighbors.

The highest law we are to obey is this:

“Love thy neighbor as thyself.” The Militia WILL SERVE THE PEOPLE, not a political agenda or party.
