ObamaCare "Unconstitutional" Judge Rules



A Florida federal judge today struck down ObamaCare, declaring it "unconstitutional."

Reuters reports:

(Reuters) - A federal judge in Florida struck down President Barack Obama's landmark healthcare overhaul as unconstitutional on Monday, in the biggest legal challenge yet to federal authority to enact the law.

U.S. District Judge Roger Vinson, appointed to the bench by Republican President Ronald Reagan, ruled that the reform law's so-called individual mandate went too far in requiring that Americans start buying health insurance in 2014 or pay a penalty.

"Because the individual mandate is unconstitutional and not severable, the entire act must be declared void. This has been a difficult decision to reach, and I am aware that it will have indeterminable implications," Vinson wrote.

This may be too complex for you to comprehend, but the judges who decided ObamaCare is constitutional made meaningless decisions. Their decisions just allowed the status quo, Obama didn't have to appeal or take any other legal action as a result.

However, Vinson's decision will lead to appeals all the way to the Supreme Court and it exposed a major error: there's no severability clause. That's why the whole thing was rendered unconstitutional.

Additionally, if Obama tries to implement it despite the decison, he could be held in contempt of a court decision.
