NRA Sues Virginia's Assault Weapons and Magazine Bans

When Abigail Spanberger ran for Virginia governor last year, she hid her radical left policy positions and tricked people into voting for her.

After she won, her true colors came out and she recently signed into law some anti-gun bills, some of which bans firearms that are commonly owned and used defying U.S. Supreme Court rulings.

The National Rifle Association has filed suit against the gun laws that ban so-called "assault weapons" (there's no such thing, by the way) and magazines.

American Hunter posted an article on the lawsuits.

They begin it with:

The National Rifle Association (NRA) has announced the filing of lawsuits in both Virginia state court and federal court challenging the so-called "assault weapons" ban and magazine ban signed into law by Governor Abigail Spanberger.

"As promised, we are taking Abigail Spanberger to court," said John Commerford, NRA-ILA Executive Director. "Throughout the legislative session, the NRA and our members fought Richmond's radical gun control package tooth and nail. We made it clear that this extreme anti-gun proposal, which bans the new purchase of commonly owned firearms and standard capacity magazines in the Commonwealth, is a blatant violation of Second Amendment rights and an affront to landmark Supreme Court cases. Instead of listening to these factual concerns from their constituents, progressive politicians sided with Michael Bloomberg and his gun-grabbing groups. The NRA will not sit idly by while progressive politicians strip the rights of law-abiding citizens, and our world-class legal team is locked, loaded, and ready to shoot down this outrageous gun-control law."

Semi-Automatic Bans Are Unconstitutional

A proposed "assault weapons" ban was considered in the most recent New Mexico legislative session. Fortunately, the measure failed to pass. 

Currently, a proposed assault weapons ban is sitting on the desk of Virginia's governor. Citizens have been rallying to urge a veto of the unconstitutional bill. 

The American Rifleman online website discusses the unconstitutionality of semi-automatic assault weapons bans by leftist Democrats. 

They begin it with:

If the logical application of the rule of law means anything in this constitutional republic, bans on massively popular semi-automatic firearms will be found unconstitutional.

That might seem a bold claim to Virginia Gov. Abigail Spanberger (D), who, as this is being written, seemed poised to sign a ban on yet another political definition of the term “assault weapon.”

This would make Virginia the 12th state with some such ban on some version of the definition of the politically shape-shifting term “assault weapon.”

Before stepping into the semantic and legal rhetoric of the potential Virginia ban on sales of America’s rifle—and the NRA’s coming legal response—some context is always beneficial.

Harris Gun Ownership: Nobody's Buying It

Comrade Kamala Harris raised eyebrows when she said that she and Gov. Tim Walz are gun owners.

The debate didn't have much about the Second Amendment, but the comment was sparked by her recent flip-flops on "assault weapons mandatory buy-backs".

According to the Buckeye Firearms Association, nobody is buying it.

They wrote:

Near the end of the debate, Davis asked, “You wanted mandatory buybacks for assault weapons. Now your campaign says you don’t,” Davis said before asking Harris why so many of her policy positions had changed, according to The Reload.

Vice President Harris didn’t address the question and was only forced to respond later to a criticism by former President Donald Trump warning voters that if elected, the vice president would have “a plan to confiscate everyone’s gun.” She jumped in with a comment that caught viewers’ attention.

“And then this business about taking everyone’s guns away, Tim Walz and I are both gun owners,” Vice President Harris stated. “We’re not taking anyone’s guns away. So stop with the continuous lying about this stuff.”

The vice president’s remark about being a gun owner drew attention. She practically never mentions being a gun owner in all her calls for more gun control and the only reference before is a glancing mention in a 2019 CNN interview. Not surprisingly, Second Amendment supporters were skeptical of her statement.

“So now Harris owns a gun? Ha, I’d love to know what kind/caliber and how often she trains with it,” competitive shooter, GunsOut TV founder and CNN commentator Shermichael Singleton posted on X.

"Assault Weapons" Ban Clears NM House Committee

Lunatic Gov. Michelle Lujan Grisham says she is all for "responsible gun ownership", but is hell-bent on infringing on our Second Amendment rights. Talking out of both sides of her mouth is not unusual for the governor.

She is praising committee passage of two gun bills. One would ban the sale of  so-called "high-capacity" (actually standard) magazines and "assault weapons" (including pistols) and the other puts a 14-day "waiting period" on the sales of guns.

EL PASO, Texas (Border Report) – New Mexico Gov. Michelle Lujan Grisham is hailing committee passage of a bill to ban the sale of assault weapons in her state.

“I am a firm believer in responsible gun ownership. […] But the fact is that our communities, our families and our law enforcement are put at risk every single day when weapons of war fall into the wrong hands,” Lujan Grisham said.

House Bill 101 would prohibit the possession, manufacturing, sale or transfer of large-capacity magazines and assault weapons in New Mexico. It passed the House Consumer and Public Affairs Committee on Tuesday on a 4-2 vote.

The committee also approved House Bill 100, which implements a 14-day waiting period for the purchaser to take possession of the gun. Its stated purpose is to “prevent impulsive acts of violence.”

The bills have a grandfather clause that allows current assault weapon owners to keep the targeted firearms provided they file an affidavit with the New Mexico Department of Public Safety.

Border Report reached out to the Republican Party of New Mexico, which has a track record of defending the rights of gun owners and is awaiting a response.

Anthony Segura, communications director of the New Mexico Shooting Sports Association, called both bills “ridiculous.”

“It doesn’t have to be an AR-15, they’re calling any rifle an assault rifle. There are other platforms, different other styles of Black rifles that are not the same caliber as an AR-15,” Segura said. “There are so many bills […] They’re not just talking about rifles, they’re also talking about pistols – as long as they have an exchangeable magazine, they want to get rid of it.”

Now that stupid voters re-elected Gov. "Malevolent Michelle" Lujan Grisham and the Democrat majority in the New Mexico legislature, you can expect assaults on our Second Amendment rights to start up again when the legislative session begins next month.

I received an email from the New Mexico Shooting Sports Association (NMSSA) which reads in part:

Many of you know that one of our main goals as an organization is to preserve our gun rights in New Mexico. The second amendment of the United State states this.

“A well-regulated Militia, being necessary to the security of a Free State, the right of the people to keep and bear Arms, shall not be infringed.”

The Second Amendment protects the right of the people to keep and bear arms for the defense of life and liberty.

The New Mexico Constitution Article II – Bill of Rights Section 6. 

No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use, and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons.

There are an estimated 415 Million guns in the United States, making us one of the largest armies in the world. The gun is the great equalizer when it comes to personal defense. There is the old cliché that states, “The only thing that stops a bad guy with a gun is a good guy with a gun.”

However, many individuals and so-called gun control groups are trying to eliminate your right to own a firearm.

We not only have to fight the anti-gun groups, but we have to deal with the falsehoods coming out of the mouths of many of our politicians.

There are Lies, Damn lies, and then there are Joe Biden's lies saying things like, “Do you realize the bullet out of an AR-15 travels five times as rapidly as a bullet shot out of any other gun?”

Not only is a modern cartridge fired by the AR-15 not “five times” faster than “any other gun,” it is actually slower than many other modern cartridges that fire similar weight projectiles. The 5.56x45mm cartridge is limited to around 3,200 feet per second in standard loadings out of the 20-inch or shorter barrels common to AR-15s. Cartridges like the .204 Ruger and .22-250 can push similar bullets up to and beyond 4,000 feet per second.

In August, the U.S. House of Representatives passed H.R. 1808, titled the “Assault Weapons Ban of 2022.” Much like the Clinton Gun Ban of the 1990s, this measure would ban many firearms simply by their appearance. Additionally, it would ban hundreds of models of AR-style and AK-style rifles by name, and even many pistols and shotguns, along with standard-capacity ammunition magazines that hold more than 15 rounds.

In the state of Oregon, under the guise of the "Reduction of Gun Violence Act," Oregon passed a Ballot Measure 114. The Ballot Measure 114 is an unconstitutional, anti-gun initiative package that includes a state-run government registry of gun owners’ personal information and firearms, requires a permit to purchase a firearm, imposes an indefinite delay on background checks, and bans any magazine with over a 10-round capacity.

New Mexicans can expect to hear a lot about gun law reform and other related issues during the 2023 60-day legislative session starting next month.

Here are some of the types of bills you can expect to see in January.

1.  Democratic Gov. Michelle Lujan Grisham has called for a statewide ban on AR-15-style rifle sales.

2.  Expanding the Red Flag Laws

3.  Raising the age limit from 18 to 21 to purchase a rifle or shotgun.

4.  A mandatory Gun Storage law, making it a crime if someone uses your gun and it is not properly locked up in your own home.

We call it the criminal protection act.

5.  A High Capacity Magazine Ban

New Mexico reelected a Governor with major anti-gun policies, and we have a new Attorney General, Raul Torres, who actually sat at the same table in the New Mexico legislature and testified with the anti-gun group Mom’s Demand Action a couple of years ago.

Biden Threatening 2nd Amendment Again

His Fraudulency Joe Biden is once again threatening our Second Amendment rights. 

Following some recent mass shootings, Biden took the opportunity call for a ban on so-called "assault weapons" during the lame-duck session of congress.

President Joe Biden and his Democrat constituents are threatening to take America’s Second Amendment away by attempting to pass a bill that would ban assault rifles during the lame-duck session before the next Congress forms. 

On Thanksgiving, Biden reiterated his support for stricter gun laws, saying that it is “ridiculous” that red flag laws were not being enforced throughout the country. 

“No. 2, the idea … we still allow semi-automatic weapons to be purchased is sick. It’s just sick. It has no, no socially redeeming value. Zero. None. Not a single, solitary rationale for it except profit for the gun manufacturers,” Biden said. 

A reporter then asked the president if he would attempt to sign new gun laws with Republicans in control of the House next year, in which Biden said that he would make that assessment as he counts votes.

“I'm going to try,” Biden said, adding “I’m going to try to get rid of assault weapons.”

Democrats In House Pass "Assault" Weapons Ban

As usual, Democrats are blaming the gun instead of the person firing it.

The House of Representatives passed an "assault rifle" ban bill that will head to the U.S. Senate where it, hopefully, will die. Contrary to what they say, there is no such thing as an "assault rifle".

WASHINGTON, July 29 (Reuters) - The U.S. House of Representatives on Friday passed legislation banning assault-style rifles that have been used in mass shootings, sending it to the Senate where it faces likely defeat.

By a mostly partisan vote of 217-213, Democrats won passage of the measure amid public anger over mass murders in which rapid-fire AR-15 rifles were used to kill and wound school children and adults engaging in day-to-day activities.

"They're easier for a teenager to get than to buy a beer," Democratic Representative Lloyd Doggett said during debate. "We've turned our churches, our schools, our shopping centers, our entertainment venues, almost any place into a battleground with one massacre after another," he added.

Democrats have been trying for years to renew a federal ban on the weapon, which was first imposed in 1994 and expired in 2004.

The ban resulted in a significant decrease in mass shootings, according to a 2021 study by Northwestern University Feinberg School of Medicine.

Republicans have resisted, accusing Democrats of attacking the 2nd Amendment to the U.S. Constitution, which grants the right to "keep and bear arms."

California's New Assault Weapons Ban

Commiefornia's new and "stronger" assault weapons ban had gone into effect on September 1.

 As Senate Bill 118 goes into effect, expanding the state’s assault weapons ban, California Attorney General Rob Bonta today announced owners of firearms that are now banned by the bill will be able to register their firearms during an upcoming three-month period. In 2020, SB 118, which then-Assemblymember Bonta voted to pass, broadened the state’s definition of “assault weapons” to include semiautomatic centerfire firearms with certain specific features. Californians who lawfully possessed these firearms before September 1, 2020, must register their eligible assault weapons with the California Department of Justice (DOJ) between 9 a.m. PST on October 1, 2021, until 11:59 p.m. PST on December 31, 2021.

“SB 118 closed a loophole in our law’s definition of assault weapons that will prevent gun manufacturers from developing and selling these firearms in California,” said Attorney General Bonta. “Many of our laws are currently under attack in the courts, but my office will continue to defend the commonsense gun laws that have worked to keep Californians safe.”

SB 118, which went into effect on September 1, 2020, changed the definition of an assault weapon to include a semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, and:

• Does not have a fixed magazine, but has any one of the attributes currently associated with assault weapons;
• Has a fixed magazine with the capacity to accept more than 10 rounds; and
• Has an overall length of less than 30 inches.

The bill exempts individuals who lawfully possessed firearms that meet the new definition before September 1, 2020, as long as they register their firearms within DOJ’s registration period: 9 a.m. PST on October 1, 2021, through 11:59 p.m. PST on December 31, 2021.

Beginning October 1, 2021, at 9 a.m., registration applications may be submitted electronically at www.oawr.doj.ca.gov or by submitting the Other Assault Weapon Registration Form (BOF 1039), which is available for download from the Forms and Publications page on the DOJ website. Additional information, including registration fees and requirements, can be found at www.oag.ca.gov/firearms/oawr-notice.

It is important to note that the registration period for “other assault weapons” differs from and is not an extension of the bullet button assault weapons registration period.
