DOJ DECLARES AGE 18-20 HANDGUN SALES BAN UNCONSTITUTIONAL

It has been federal law that 18-year-olds were not allowed to purchase firearms. It has been law that they have to reach age 21 to do so.

This is starting to change. The Supreme Court is expected to finally determine whether laws banning adults under 21 from buying firearms is unconstitutional.

The U.S. Department of Justice issued a memorandum opinion on this matter.

The NRA-ILA reported:

On September 17, the Department of Justice’s Office of Legal Counsel (OLC) issued a memorandum opinion to answer the question “whether restricting young adults from buying firearms comports with the Second Amendment as the Supreme Court has authoritatively construed it.” OLC, focusing specifically on provisions of federal law that criminalize the sale of handguns to adults aged 18 to 20 by federally licensed dealers (FFLs), said “no.” This interpretation marks a sea change in the government’s approach to an issue that has been the subject of decades of litigation, including by NRA, up to the present day. How it plays out practically, however, remains to be seen.

DOJ Sues Denver Over Unconstitutional Weapons Bans

Colorado was once a red state (i.e., Republican), but Democrat liberals have moved into this state and now are inflicting their ideology on the people there.

The Second Amendment rights of Colorado's citizens are under attack. Now, the Denver city council is trying to ban so-called assault weapons and now are being sued by the Trump Department of Justice.

From Justice.gov:

Today, the Justice Department filed suit against the City of Denver, Colorado alleging that the City unconstitutionally bans certain constitutionally protected semi-automatic rifles. These laws unconstitutionally infringe on the Second Amendment rights of law-abiding citizens to keep and bear arms in common use for lawful purposes.

As the complaint explains, the City enforces an ordinance that makes it a crime to possess so-called “assault weapons.” But that the City’s ban includes AR-15-style rifles, which are the most popular rifles in America. Law-abiding Americans own tens of millions of rifles like those banned by the City.

“The Constitution is not a suggestion and the Second Amendment is not a second-class right,” said Acting Attorney General Todd Blanche. “Denver's ban on commonly owned semi-automatic rifles directly violates the right to bear arms. This Department of Justice will vigorously defend the liberties of law-abiding citizens nationwide.”

2nd Amendment Is Meaningless If the Government Can Kill You For Exercising It

The fatal shooting of Minneapolis protestor Alex Pretti by ICE has divided (to a large degree) Second Amendment rights groups and the DOJ/ICE/Trump Administration.

The shooting of Pretti seems at first glance to be unjustified as videos of the shooting indicate he did not make any threatening moves with his pistol. Videos show that he was taken to the ground, had his pistol removed from his person and then was shot to death. The item in his right hand in the above video was a phone.

Final judgement of the incident is pending an investigation that is now underway.

The Cato Institute has posted an article on the shooting.

It starts off with:

What a difference four days can make. Last Tuesday, a top DOJ lawyer argued in the Supreme Court that people have a right to carry guns in public. By Saturday, another DOJ official warned: “If you approach law enforcement with a gun, there is a high likelihood they will be legally justified in shooting you.” The government went from championing gun rights to defending ICE agents’ fatal shooting of Alex Pretti. Only restraints on the use of force can stop officials from turning the Second Amendment into an excuse to kill civilians.

Facts are still emerging about the Minneapolis shooting of Mr. Pretti by immigration agents, but videos show that they took him to the ground and appear to have removed a pistol from his waistband, then shot him to death. Mr. Pretti had a gun-carry permit.

Government officials rushed to defend the shooting. High-ranking DOJ prosecutor Bill Essayli wrote, “If you approach law enforcement with a gun, there is a high likelihood they will be legally justified in shooting you.” FBI Director Kash Patel declared, “You cannot bring a firearm, loaded, with multiple magazines to any sort of protest that you want. It’s that simple.”

Second Amendment advocates responded quickly. The NRA condemned Mr. Essayli for “making generalizations and demonizing law-abiding citizens.” Gun Owners of America demanded respect for “Americans’ right to bear arms while protesting.” Former NRA representative Dana Loesch asked Mr. Essayli, “Do you believe that mere legal possession within the vicinity of [an officer]…merits use of force as a response?” Congressman Thomas Massie (R‑KY) wrote, “Carrying a firearm is not a death sentence.”

Trump Administration Sues Washington DC Over Gun Laws

The Trump Justice Department is suing Washington, DC over its semiautomatic restrictions, saying it violates the Second Amendment.

MSN reported:

Donald Trump-led US administration is suing the Washington, DC, government over its gun laws, arguing that restrictions on certain semiautomatic firearms violate the Second Amendment rights. The US Department of Justice filed the lawsuit on Monday in the District Court for the District of Columbia, naming the Metropolitan Police Department and outgoing police chief Pamela Smith as defendants.

The case sets up a major legal battle over how far governments can go in regulating individual gun ownership.

"The United States of America brings this lawsuit to protect the rights that have been guaranteed for 234 years and which the Supreme Court has explicitly reaffirmed several times over the last two decades,"the Justice Department said in its filing.

Trump DOJ Supports Cuba Lawsuit Against Cruise Lines

Above, Havana's Sierra Maestra cruise terminal. Photo by Armand Vaquer.

Politics, including international trade relations, sometimes makes strange bedfellows, even involving lawsuits.

The following article caught my attention by its headline, "Trump DOJ Supports Cuba Lawsuit Against Cruise Lines".

This involves dock facilities at Havana Port that were confiscated by Cuba's communist government. I took a cruise to Havana back in April 2019 and the ship, Majesty of the Seas of Royal Caribbean, used those dock facilities after our arrival. President Trump ended vacation cruises to Cuba in June 2019.

According to Seatrade Cruise News:

The US Department of Justice wants the Supreme Court to review an appeals court decision that sided mostly with cruise lines sued for using Havana docks which had been confiscated by Cuba's communist government.

The 11th Circuit Court of Appeals in October 2024 ruled mostly in favor of cruise companies that were sued under under Title III of the Helms-Burton or Libertad Act which allows US nationals to seek compensation for property taken over by Cuba. The US national, Havana Docks, held a concession to operate facilities that were used by Carnival Corp., Royal Caribbean Group, Norwegian Cruise Line Holdings and MSC Cruises.

Appeals court decision

The appeals court determined the property of Havana Docks confiscated by Cuba was the concession right to operate and profit from the docks for 99 years, which was set to expire in 2004. The facilities were used by the cruise lines from 2016 to 2019. The court said Havana Docks did not own the real property but had the concession right to operate and benefit from the port.

Above, yours truly at Havana Port just after our arrival.

Concerns Raised Over Biden's 'Autopen' Presidency

Many documents requiring the signature of His Fraudulency Joe Biden just may not be legal. Many were found to have been signed by an autopen.

These include "signed" executive orders, legislation and pardons. An investigation by the Justice Department is being called for.

According to Newsmax:

The use of an autopen signature on many official White House documents and executive orders purportedly signed by former President Joe Biden has stoked concerns about his awareness of signing certain things and whether he actually signed them at all, according to an investigation by the Oversight Project, an arm of the Heritage Foundation.

According to the group, "every document we could find" that bore Biden's signature all "used the same autopen signature" except for his announcement about leaving the 2024 presidential race last July.

"Whoever controlled the autopen controlled the presidency," the Oversight Project said in a post to X on Thursday.

The concerns are such that Missouri Attorney General Andrew Bailey is demanding a Department of Justice investigation as to whether "Biden's cognitive decline allowed unelected staff to push through radical policy without his knowing approval."

In a letter to DOJ Inspector General Michael Horowitz dated March 4, Bailey wrote that "it appears staffers and officers in the Biden administration may have exploited Biden's incapacity so they could issue orders without an accountable President of sound mind approving them."

19 Attorneys General Opposing DOJ Gun Confiscation Program

19 attorneys general are opposing the Biden Administration's "red flag" gun confiscation program and are urging the DOJ to scrap it.

I have personal experience with California's "red flag" law brought on through a restraining order by a vindictive ex-girlfriend. It was dismissed during a court hearing as I had proof that there was no basis for the restraining order.

According to the Highland County Press:

COLUMBUS – Ohio Attorney General Dave Yost and 18 other state attorneys general are opposing a new federal program that promotes aggressive enforcement of “red flag” gun-confiscation laws.

Yost and his counterparts argue in a letter to U.S. Attorney General Merrick Garland that the National Extreme Risk Protection Order (ERPO) Resource Center, launched in March by the Department of Justice, undermines the Second Amendment and other fundamental rights in a flawed attempt to reduce gun violence.

“The solution to gun violence is not more bureaucracy, and it is certainly not parting otherwise law-abiding men and women from their right to self-defense,” Yost said.

The state attorneys general raise several concerns with the ERPO Resource Center, most notably how the program advocates for laws that allow government officials to “suspend fundamental rights under the Second Amendment with no genuine due process."

So-called “red flag” laws permit authorities to seek court orders authorizing the confiscation of firearms from people thought to pose a danger. Twenty-one states have enacted such laws; Ohio is not among them.

Another issue is whether the DOJ had authority to create the program in the first place. The Bipartisan Safer Communities Act, cited by the department as the impetus for the ERPO Resource Center, makes no mention of such a program. In fact, the letter says, that funding from the 2022 federal law was supposed to go to states and local governments.

Miroku Firearms Mfg. Co. of Japan

It is ironic that the Japanese company Miroku Firearms Mfg. Co. manufactures firearms such as the Winchester 94 lever-action rifle. But the average Japanese citizen cannot own handguns or rifles.

I have been to Japan eight times over the years and it was only recently I learned about Miroku.

According to the U.S. Department of Justice Office of Justice Programs:

Annotation

Japan's strict gun-control laws are unfair and oppressive; although some people assert that Japan's low crime rate is due to gun control, it is actually due to Japan's culture.

Abstract

Other than the police and the military, no one in Japan may purchase a handgun or a rifle. Hunters and target shooters may possess shotguns and airguns under strictly circumscribed conditions. The police check gun licensees' ammunition inventory to make sure there are no shells or pellets unaccounted for.

Note: The above was published in 1992. However, nothing has changed since then.

From Miroku's website:

Miroku has come along with the history of Japan's hunting gun production.

The founding root of Miroku Firearms Mfg. Co. was 1893 (Meiji 26).

It is the starting point of the Miroku Group and is also the core of the gun business.

The country's No.1 hunting gun manufacturer "Miroku" started from here.

Their products have been praised by gun enthusiasts. They aren't cheap imported "Saturday night specials".

Their product lines includes B.C. Miroku, Browning, Winchester and miroku OP.

Hunter Biden's Plea Deal Reportedly Implodes

Above, Hunter Biden.

Despite the "sweetheart deal" that Hunter Biden was going to plead on, he was never really out of the legal woods.

Well, he's definitely back deep into the woods again as the plea deal imploded.

The Daily Caller reported:

Hunter Biden’s plea deal on tax misdemeanors charges is off, CNN reported Wednesday.

Biden had been expected to plead guilty to tax misdemeanor charges Wednesday in a Delaware court, entering a plea deal with the Department of Justice (DOJ) on the tax misdemeanor charges to avoid jail time on a separate gun charge.

The plea deal reportedly fell apart after the defense and prosecution did not agree on the scope of the immunity of coverage that Biden had, specifically if Biden would be covered from being charged on Foreign Agents Restoration Act (FARA) in the future.

Tucker Carlson: Ep. 5, The Truth About Hunter Biden

The "slap on the hand" of Hunter Biden yesterday by his daddy's Justice Department smells like a fish market warehouse. Many people are shaking their hands over the plea deals he received. The two-tier justice system is definitely an unfair one.

Carlson takes a look at what should have been done and what actually was done.

Larry Kudlow: "Sobering", "Dastardly" and "Sad Day" In America

Fox Business contributor Larry Kudlow weighed in on the Trump indictment by the Biden/Merrick Garland Department of Justice.

He begins with:

Yesterday was a sobering day for the entire country and of course, for former President Donald Trump.  As you know, Mr. Trump pleaded not guilty to all the politicized and weaponized charges ginned up by Joe Biden and the Merrick Garland Justice Department aimed at stopping him from becoming president. They know full well that if Trump were elected to a second term he will clean out the corrupt stables in the Washington, D.C. swamp.

The real-world scenario of a sitting president attempting to throw his principal opponent into jail is surely one of the most dastardly actions ever taken in American history, stuff that is typical in third-world countries or communist nations, but never before in America.

50 Trump Supporters' Homes Raided By Biden's Gestapo

There are dangerous times we live in.

First, the residence of a former president was raided by the FBI.

Now, up to 50 homes of Trump supporters have been raided by the FBI on Thursday.

The Gateway Pundit posted:

On Friday afternoon Steve Bannon told Charlie Kirk that 35 Trump allies had their homes raided by the FBI on Thursday.

Bannon: “The jack-booted Gestapo has to show up at their door and make a big display of this.”

Steve Bannon joined Charlie Kirk on Real America’s Voice on Thursday to break the news.

Steve Bannon: You saw from the demonic speech that Biden gave in Philadelphia that this is a dying regime. That was a primal scream. And here what they’re trying to do, no matter who it is whether Donald Trump at Mar-a-Lago. There were 35 FBI raids last night. Right. And there’s another grand jury coming together on January 6th, the Washington Post reported it. THIRTY-FIVE Senior Members of MAGA! of Republicans, supporters of Donald Trump that the FBI rolled in on. When they didn’t need to do it. Right? All these people have lawyers. The jack-booted Gestapo has to show up at their door and make a big display of this.

This has never happened in American history!

The evil regime has gone rogue!

On Friday night attorney Harmeet Dhillon went on with Tucker Carlson to discuss the mass FBI raids on Trump supporters.

Harmeet told Tucker that up to 50 Trump supporters may be involved in these raids.

At least one liberal reporter was tipped off to the FBI raids before they took place.

Harmeet Dhillon: The subpoenas are intentionally broad. They’re from the “Capitol Siege Section” of the United States Department of Justice DC Office. And they ask for broad categories of documents. They ask for all communications dated from a month before the election until two months after the election. And they ask for all communications regarding dozens of people. And the categories are alternate electors, fundraising around irregularities around the election, and also a rally that happened before the January 6 situation at the Capitol. The Save America Rally that happened. Basically, all of this activity if not all of it is protected by the First Amendment. And the United States Department of Justice is telling reporters about the search warrants and subpoenas before they’re executed… This is really outrageous abuse by the DOJ.

DOJ and CDC To Appeal Voided Mask Mandate Decision

Above, the Albuquerque Sunport terminal. Photo by Armand Vaquer.

The following does not come as a surprise since liberals despise losing power over people.

Source New Mexico reported:

UPDATE: Tuesday, April 19, at 4:30 p.m.

The U.S. Department of Justice and CDC released a statement Tuesday evening saying the entities, “disagree with the district court’s decision and will appeal, subject to CDC’s conclusion that the order remains necessary for public health.” NBC News reports that the DOJ will not seek an emergency stay while it appeals the court’s ruling, meaning the mask mandate will not be in effect during the appeals process.

Rail Runner and the Albuquerque Sunport are doing away with mask requirements in keeping with the decision to void the federal mask mandate of yesterday.

Biden's DOJ Targeting Parents

Parents are being harassed by the Department of Justice for protesting against Critical Race Theory and mask mandates at school board meetings.

People are only exercising their First Amendment rights to free speech. The actions by the Department of Justice is right out the totalitarian playbook

The New York Post reported:

Parents and politicians are slamming the Department of Justice’s decision to bring in the FBI to investigate a spike in “threats against school administrators, board members, teachers, and staff,” saying the Biden administration is likening their protests of “woke” policies such as Critical Race Theory — as well as mandatory mask wearing — to “domestic terrorism.”

“Dear @TheJusticeDept Merrick Garland and @FBI Director Christopher Wray,” Asra Nomani, vice president of investigations and strategy at Parents Defending Education, posted on Twitter. “This is what a domestic terrorist looks like? You are criminalizing parenting, and you owe the people of America a swift apology.”

She sarcastically signed the missive, “‘Domestic Terrorist,’ Asra Nomani.”

Nomani’s group has been researching how school boards across the US implement “woke” ideas into curricula, such as critical race theory.

In recent months, dozens of parents have taken a stand in school board meetings against the teaching of Critical Race Theory in classrooms and to protest mask mandates, causing some to wonder what the FBI and DOJ are actually investigating.

House Minority Leader Kevin McCarthy has joined the fray by posting the above Tweet on Twitter.

California's New Assault Weapons Ban

Commiefornia's new and "stronger" assault weapons ban had gone into effect on September 1.

From a Press Release by the California Department of Justice (courtesy of Redheaded Blackbelt):

Press release from the California Department of Justice:

As Senate Bill 118 goes into effect, expanding the state’s assault weapons ban, California Attorney General Rob Bonta today announced owners of firearms that are now banned by the bill will be able to register their firearms during an upcoming three-month period. In 2020, SB 118, which then-Assemblymember Bonta voted to pass, broadened the state’s definition of “assault weapons” to include semiautomatic centerfire firearms with certain specific features. Californians who lawfully possessed these firearms before September 1, 2020, must register their eligible assault weapons with the California Department of Justice (DOJ) between 9 a.m. PST on October 1, 2021, until 11:59 p.m. PST on December 31, 2021.

“SB 118 closed a loophole in our law’s definition of assault weapons that will prevent gun manufacturers from developing and selling these firearms in California,” said Attorney General Bonta. “Many of our laws are currently under attack in the courts, but my office will continue to defend the commonsense gun laws that have worked to keep Californians safe.”

SB 118, which went into effect on September 1, 2020, changed the definition of an assault weapon to include a semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, and:

The bill exempts individuals who lawfully possessed firearms that meet the new definition before September 1, 2020, as long as they register their firearms within DOJ’s registration period: 9 a.m. PST on October 1, 2021, through 11:59 p.m. PST on December 31, 2021.

Beginning October 1, 2021, at 9 a.m., registration applications may be submitted electronically at www.oawr.doj.ca.gov or by submitting the Other Assault Weapon Registration Form (BOF 1039), which is available for download from the Forms and Publications page on the DOJ website. Additional information, including registration fees and requirements, can be found at www.oag.ca.gov/firearms/oawr-notice.

It is important to note that the registration period for “other assault weapons” differs from and is not an extension of the bullet button assault weapons registration period.

Second Amendment Battle Brewing Between Feds and Missouri

“All laws which are repugnant to the Constitution are null and void.” (Marbury vs.Madison, 1803.)

“Every law consistent with the Constitution will have been made in pursuance of the powers granted by it. Every usurpation or law repugnant to it cannot have been made in pursuance of its powers. The latter will be nugatory and void.” (Thomas Jefferson, Elliot, p. 4:187-88.)

Laws passed that are "repugnant to the Constitution are null and void"  are as if they were never have existed in the first place.

A battle is brewing between His Fraudulency's Department of Justice and the state of Missouri over the state's Second Amendment Preservation Act.

According to KRMS News:

Missouri and the Federal Government are going head-to-head on gun law enforcement.

The Justice Department wrote Missouri to say the state went too far with the Second Amendment Preservation Act.

But Governor Mike Parson and Missouri Attorney General Eric Schmitt wrote back to say they will enforce the new state law at all costs.

Under the new law signed by Parson last Saturday, a person or entity that infringes on the Second Amendment would face a $50-thousand dollar fine for each occurrence.

Missouri Attorney General Eric Schmitt and Governor Mike Parson today sent a letter to President Biden’s Department of Justice fighting back against potential federal overreach and encroachment on Missourians’ Second Amendment rights.

The full letter can be found here: https://ago.mo.gov/docs/default-source/press-releases/2021-6-17-ltr-boynton.pdf?sfvrsn=ae1b68e_2

“Missourians’ and Americans’ Second Amendment rights are enshrined in the Constitution – I will defend those rights at every turn,” said Attorney General Schmitt. “Our letter to Biden’s Department of Justice sends a clear message: we will fight any attempts from the federal government to encroach on the Second Amendment rights of law-abiding citizens.”

“The Second Amendment Preservation Act is about protecting law-abiding Missourians against government overreach and unconstitutional federal mandates,” Governor Parson said. “We will reject any attempt by the federal government to circumvent the fundamental right Missourians have to keep and bear arms to protect themselves and their property. Throughout my career, I have always stood for the Constitution and our Second Amendment rights, and that will not change today or any day.”

We need more governors and attorneys general like Governor Parson and Attorney General Eric Schmitt.

Justice Dept. Files Antitrust Lawsuit Against Google

Just a few minutes ago, I spotted this on Twitter:

Good, it's about time that the giant tech companies' are held accountable for their unfair business practices.

Hopefully, similar action against Facebook and Twitter will follow. Facebook is already under investigation.

From the Wall Street Journal:

WASHINGTON—The Federal Trade Commission is gearing up to file a possible antitrust lawsuit against Facebook Inc. FB 0.95% by year-end, according to people familiar with the matter, in a case that would challenge the company’s dominant position in social media.

The case preparations come after the FTC has spent more than a year investigating concerns that Facebook has been using its powerful market position to stifle competition, part of a broader effort by U.S. antitrust authorities to examine the conduct of a handful of dominant tech companies.

No final decision has been made on whether to sue Facebook, people familiar with the matter said, and the commission doesn’t always bring cases even when it is making preparations to do so, such as when it decided against filing an antitrust complaint against Google Inc. in 2013 after a lengthy investigation.
